OUR COMMITMENT TO OUR MEMBERS: If in a lien action in a court of legal jurisdiction, it is ruled that there was insufficiency of notice due to an error on the part of American Contractors' Foundation, we will pay our member the cost of the amount claimed in the lien that was dismissed, and assume the debt owned our member. We will cover this cost personally, or through our Errors & Omissions Insurance.
LEGAL ADVICE: The information contained in this web site is for the purposes of providing construction lien services to our members, including but not necessary limited to: Pre-Lien Notice-To-Owner, Property Liens, Lien Releases, Bond Notices, Bond Claims, Status Reports, Property Owner and Parcel Numbers, etc. The information contained in this web site and/or received from representatives of American Contractors' Foundation does not constitute legal advice and should not be construed as such. All members of American Contractors' Foundation designate American Contractors' Foundation as its agent and grants American Contractors' Foundation power of attorney for the sole purpose of performing the services specified and request by its members and agreed to by American Contractors' Foundation. The member agrees to defend and hold harmless American Contractors' Foundation from all claims resulting from the acts requested of American Contractors' Foundation or its authorized representatives for services performed on behalf of its members and its members request. The member waives all present and future claims against American Contractors' Foundation which may result from acts of American Contractors' Foundation or its authorized representatives that it was requested to do by its members. Jurisdiction and venue for any legal action involving the member and American Contractors' Foundation shall lie in King County Superior Court for the State of Washington.
LIMITATIONS OF LIABILITY/LIABILITIES NOT ASSUMED: American Contractors' Foundation relies upon information provided by the member in the mailing and filing of notices, liens and all other claim documents. American Contractors' Foundation will not be liable for any errors or omissions from faulty information provided to it by the member or from circumstances beyond its control. The member acknowledges that American Contractors' Foundation for its own acts or omissions shall be limited to the amount of any filed lien claim for work performed by the member on a specific.
INTERACTIVE WEB SITE: Thefree pre-lien notice-to-owner interactive web site is accessible by members using a user identification (facsimile number) and password that is initially set up when the members completes their first notice-to-owner or lien form. Once the client has completed the member has filed the first form, this constitutes an active member of American Contractors' Foundation and the member has continually access to the information pertaining to that member specifically. The interactive web site will contain member information regarding the pre-lien notices-to-owner sent and active in the system. The interactive web site will contain lien request information, bond request information, lien release information, and all other pertinent information relating to the member and being or having been performed by American Contractors' Foundation. The free pre-lien notice to owner aspect of the service provided by American Contractors' Foundation is done without a fee being retained by American Contractors' Foundation. American Contractors' Foundation has a cost of mailing associated with each notice request done through the interactive web site and this cost will be passed on to the member and reported in the information in the interactive web site specific to the member. It is the member's responsibility to review the information, and specifically to take account of the mailing costs and web access cost of the notices sent and to submit payment to American Contractors' Foundation monthly. Interest will be charged at two percent (2) per month, broken down by day on all costs incurred by American Contractors' Foundation for mailings that exceed sixty (60) days. Each quarter American Contractors' Foundation will submit to the member a statement that includes all payments received and costs incurred by American Contractors' Foundation with the respect to the free pre-lien notice-to-owner aspect of the interactive web site and more specifically to the mailing costs and web access costs. These costs are the member’s responsibility and are fronted by American Contractors' Foundation as a convenience to its members. All other liens, bond claims, lien releases and etc. will be invoiced separately to the member or will require payment terms prior to initiating work requested by the member.
ESSENTIAL INFORMATION TO PARTICIPATE IN THE FREE NOTICE-TO-OWNER INTERACTIVE WEB SITE: The member is responsible for providing at the time of completing a free pre-lien notice-to-owner the essential information to legally comply with the notice requirements of the specific state of the job site. Specifically, the member must provide an accurate job site address to make the notice legally binding. If such information is not accurately provided, the notice will be rejected and processed manually. Accordingly, the client acknowledges that if such free pre-lien notice-to-owner is rejected and processed manually, the standard pricing for conventional pre-lien notice-to-owner will apply. It is the member’s responsibility to purchase a notice package as provided in this web site if the member wishes to take advantage of cost saving of notice package pricing. Otherwise, all notices processed manually will be charged the single notice pricing including the certified return receipt five ounce large package pricing of seven fifty nine ($7.59) per notice set with a minimum of two notices sent per notice request.
INACCURACY OF INFORMATION ENTERED: In the event that the member enters inaccurate information into the interactive web site or onto a request form that is facsimiled to American Contractors' Foundation, the member must immediately notified American Contractors' Foundation of such error. If the error occurred on the free pre-lien notice-to-owner aspect of the interactive web site, the notice will be removed and processed manually and all standard pricing for conventional pre-lien notice-to-owner fees will apply. If the member notifies American Contractors' Foundation of the inaccuracy prior to the processing of a conventional pre-lien notice-to-owner (usually within twenty four hours) the correction will be made and the member will not incur any additional research or other fees. If the pre-lien notice-to-owner, lien, bond claim, etc. has been submitted then an amended document will be processed and will be charged to the member as a separate document charge.
REPUTED OWNER: The interactive web site for free pre-lien notice-to-owner will automatically enter into the owner of the property section of the request form the term "Reputed Owner" and the address of the job site. Under most state laws this will be sufficient to confer legality of the pre-lien notice-to-owner. However, some states require that the information be the actual owner’s address. Accordingly, the member assumes the risk that if the actual owner name and actual owner address of the property is not entered correctly, that the notice will not comply with state law and will therefore be ineffective as to protecting the member’s lien rights.
OUTSIDE INFORMATION AND TIMELY SUBMISSION: While ever reasonable effort will be made to gather reliable information, if information is gathered from outside public records and private sources, it is without independent verification by American Contractors' Foundation; no representation is made as to such information’s ultimately accuracy. Correspondingly American Contractors' Foundation shall not be liable for any inaccuracies or errors contained therein, or any errors or inaccuracies contained in public records or from private sources. It is the member’s responsibility to assure that all pre-lien notice-to-owner requests are timely and accurate, and if requested past the statutory deadline and mailed by American Contractors' Foundation, the member shall remain responsible for the mailing costs and web access fees incurred by American Contractors' Foundation even though the notice document is invalid.
